By visiting our website, subscribing to any of our services, or engaging in our promotions, you("you", "your", "member", "user") acknowledge and agree to be bound by these Terms and Conditions, including any policies referenced herein.

GENERAL

1.1 Website Usage

You are permitted to use this website solely for lawful purposes and in accordance with these Terms and Conditions. You must not use the website in any way that could harm, disable, overload, or impair its functionality, nor interfere with any other user’s access or experience. AMTCircle reserves the right to restrict or suspend access to the website without notice for any misuse.

1.2 Privacy & data protection

Your use of this website is subject to our Privacy Policy, which is incorporated into these Terms by reference. By accessing the website, you consent to the collection, use, and disclosure of your personal information as outlined in the Privacy Policy.

1.3 Intellectual Property RIGHTS

1.5 Limitation of Liability

To the maximum extent permitted by applicable law, AMTCircle and it's affiliates, officers, directors, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the website or any services or content provided through it.

1.6 Indemnity

You agree to indemnify and hold harmless AMTCircle Ltd, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, or expenses (including legal fees) resulting from your use of the website or breach of these Terms.

1.7 Amendments to Terms

AMTCircle Ltd reserves the right to update or modify these Terms at any time without prior notice. Continued use of the website following any changes indicates your acceptance of the revised Terms.

1.8 Governing Law and Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws of Samoa. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Samoa.

2. Subscriptions

2.1 The services

AMTCircle Ltd provides membership-based subscription services that offers its members discounts at partnered stores and services across Samoa and a rewards points programme. By subscribing, members agree to pay the applicable fees and comply with these terms and conditions. All fees are payable in advance and are non-refundable, except where required by Samoan law. The availability, type and value of discounts will depend on agreements between AMTCircle and its partner businesses and may be subject to change without prior notice. The specific benefits available under each subscription tier or package may vary and will be outlined at the time of purchase.

2.2 Subscription options

AMTCircle offers recurring monthly subscriptions at four price points. $10, $25, and $50 per month plus our $100 VIP Package. In addition to these recurring options, AMTC also offer one-off packages including $5(activated from time to time), $10, $20, $30, $50, $100 and $150. AMTCircle reserves the right to modify, enhance, or withdraw services, benefits, or features at it's discretion, provided that members are given reasonable notice where such changes materially affect their subscription.

2.3 Payment and billing

Members are responsible for ensuring that their subscription fees are kept up to date. As AMTCircle does not operate an automatic billing system, members must manually renew their subscription each month to maintain access to membership benefits. Payments may be made through approved mobile wallet services in Samoa or by Cash at authorized AMTCircle Agents. All prices  for subscriptions, packages, and services are listed in Samoan Tala (WST) unless otherwise stated. Failure to renew a subscription by the due date may result in suspension or loss of membership benefits until payment is received.

2.4 Renewal and cancellation

You may cancel your subscription at any time through your account dashboard or by contacting our office. Cancellations take effect at the end of the current billing cycle. You will continue to receive membership benefits until that time. Reward points and giveaway entries will be held for one month following cancellation. If you reactivate your subscription within that month, your points and entries will be restored. After one month of inactivity, any unclaimed points and entries will expire permanently. No partial refunds will be issued for cancellations made partway through a billing cycle.

2.5 Refunds and adjustments

All subscription and package fee are non-refundable except where required by law. To be considered for a refund, the Customer must submit a formal cancellation or refund request. AMTCircle will review the request and notify the Customer of the outcome. If approved, applicable funds will be refunded. AMTCircle does not provide credits or refunds for unused portions of a subscription package. In the event of a billing error, AMTCircle will investigate and if necessary issue an appropriate adjustments.

2.5 Usage Restrictions

Subscriptions and associated benefits are for personal use only and may not be shared, sold, or transferred without prior written approval from AMTCircle Ltd.

2.6 Limitation of Liability

To the fullest extent permitted under the laws of Samoa, AMTCircle shall not be held liable for any loss, damage, or expense—whether direct, indirect, incidental, or consequential—that arises from or is in any way connected to your subscription. This includes, but is not limited to, issues relating to access, use, suspension, or termination of the subscription services. AMTCircle is not responsible for lost or expired benefits, failure to renew due to no payment received, or changes in subscription features.

3. REWARDS REDEMPTION

3.1 Eligibility

Only active AMTC members with a valid and current membership subscription are eligible to earn and redeem rewards.

3.2 Earning POINTS

Members earn 1 point for every WST$1 spent, when receipts are submitted and approved by AMTCircle. Members may also earn points by completing official AMTCircle challenges or promotions. Receipts must be valid, dated, and submitted within a timeframe set by AMTCircle. Duplicate or altered receipts will not be accepted. AMTCircle reserves the right to verify and approve all submitted receipts before points are awarded.

3.3 Redemption of points

Points may be redeemed for AMTCircle vouchers according to the following scale: 

1,000 points = WST $50 Voucher.

Vouchers can only be used at participating stores and service providers. Points have no cash value and cannot be exchanged for money. All vouchers issued through AMTCircle are strictly non-refundable and cannot be exchanged for cash, credit, or alternative rewards. Vouchers are non-transferable and must be used solely by the member who redeemed them. They may not be gifted, sold, or reassigned to another individual. Once redeemed, points are deducted from the members account and cannot be reversed.

3.4 Partner Terms and Conditions

Each voucher offered through AMTCircle is governed by the terms and conditions of the respective partner or service provider.  Partner stores may apply specific conditions on redemption, such as eligible products, services, or minimum spend requirements. Members are responsible for reviewing and complying with these terms prior to using our vouchers. AMTCircle is not responsible for the quality, safety, or performance of goods and services provided by partners.

3.5 Members responsibility

Members must keep their membership details accurate and updated. Proof of membership and/or voucher code must be presented to redeem rewards. Lost or stolen vouchers will not be reissued.

3.6 Expiry and limitations

Points must be redeemed within 6 months from date they are earned, unless otherwise stated. Expired points cannot be redeemed. Vouchers must be used before the expiry date printed on them. Rewards cannot be combined with other discounts, promotions, or loyalty programs unless specifically allowed.

3.6 High-Value Purchase Rewards Cap

To ensure the long-term sustainability of the AMTCircle Rewards Program, the following earning caps apply to high-value purchases. These limits define the maximum number of points that can be earned per transaction or per item, regardless of the total amount spent.

• Cap: Points will be awarded on up to WST $5,000 of the total vehicle purchase.
• Maximum Points Earned: 5,000 points (equivalent to WST $250 in vouchers).

Home Appliances & Electronics

• Applies to items such as refrigerators, TVs, air conditioners, washing machines, and similar.
• Cap: Points will be awarded on up to WST $3,000 per item.
• Maximum Points Earned: 3,000 points (WST $150 in vouchers).

• Applies to beds, sofas, dining sets, and other large furniture items.
• Cap: Points will be awarded on up to WST $2,000 per item.
• Maximum Points Earned: 2,000 points (WST $100 in vouchers).

• Applies to smartphones, tablets, laptops, and similar electronics.
• Cap: Points will be awarded on up to WST $2,000 per device.
• Maximum Points Earned: 2,000 points (WST $100 in vouchers).

• Applies to gold, watches, designer items, and other high-end goods.
• Cap: Points will be awarded on up to WST $2,500 per item.
• Maximum Points Earned: 2,500 points (WST $125 in vouchers).

• These caps apply per item or transaction, not per receipt.
• If multiple high-value items are purchased in one transaction, each item will be evaluated individually against its respective cap.
• AMTCircle reserves the right to request itemized receipts for verification.
• These caps may be reviewed and adjusted periodically.

4.6 Entry Conditions

Multiple entries allowed per person based on the entry package purchased. No maximum entry limit. Entries must be submitted during the promotional period. Only eligible entrants may win. You are responsible for your own entry costs and internet access. Promotion ends on 01/11/2025. AMTCircle staff and immediate family members are not entitled to participate.

4.8 Participant Conduct

Entrants must not tamper with the promotion in any way, act in a disruptive or harmful manner that will damage the reputation of the Promoter and it's partners, suppliers, and all other associates to the Promotion.

4.9 Draw Details

One winner will be selected per prize. Draw conducted via our in-house digital system in the presence of a Gambling Control Authority Samoa representative.

4.10 Winner Notification

Winners will be announced on the AMTCircle facebook page and website. It will be listed for at least 28 days. Winners will be contacted via phone and email within 48 hours of the draw.

Under GCA gambling regulations, participation age is 21 years and above. In the case of minors, prizes will be awarded to their parents or legal guardians on their behalf.

4.11 Prize Claiming

Claim Date: 02 November 2025

Promoter will notify prize winners by phone and email within 48 hours of the draw. Prizes must be accepted as offered. No cash exchange, resale, or transfer unless approved by the promoter. If a prize becomes unavailable, a substitute of equal or greater value may be offered. Winners are responsible for any taxes or duties applicable in Samoa. Reserve winners may be drawn in case of disqualification or unclaimed prizes. The promoter will make reasonable efforts to contact winners

4.13 Limitation of Liability

4.13.1 Subject to the maximum extent permitted under applicable law, the Promoter shall not be held liable for any personal injury, death, loss, or damage—whether direct, indirect, incidental, or consequential—suffered by any individual or property as a result of participating in this Promotion, or arising from the acceptance, possession, use, or misuse of any Prize awarded under this Promotion.

4.13.2 In addition to Clause 4.13.1, the Promoter, including its affiliates, prize suppliers, and associated entities, shall bear no responsibility or liability for any of the following:

• Entries that are incorrectly submitted, incomplete, or ineligible;

• Failure by a participant to claim a Prize within the designated timeframe;

• Any damage, delay, or loss occurring during the delivery or transfer of a Prize;

• Any failure to receive communications from the Promoter due to technical issues, incorrect contact details, or other circumstances beyond the Promoter’s control.

4.13.3 In the event that the Promotion cannot proceed as planned due to circumstances beyond the reasonable control of the Promoter, including but not limited to system failures, technical malfunctions, tampering, fraud, or other unforeseen disruptions, the Promoter reserves the right to modify, suspend, postpone, or cancel the Promotion. The Promoter may also disqualify any affected Entries, subject to any required approval from relevant regulatory authorities, where applicable.

4.14 General

4.14.1 Nothing in these Terms and Conditions shall be interpreted as limiting, excluding, or modifying any rights granted to consumers under applicable laws in Samoa, including the Competition and Consumer Act 2016 and other relevant consumer protection legislation.

4.14.2 From time to time, AMTCircle may run free giveaways, promotions, or competitions (including livestream events). Participation is always free and no purchase is required. Winners will be chosen fairly—either randomly or through a clearly explained method of chance or skill. We’ll announce winners publicly and ensure all prizes are awarded as promised.

4.14.3 By participating in this Promotion, you agree that any disputes arising in connection with the Promotion and/or these Terms and ​Conditions shall be governed by the laws of Samoa and subject to the exclusive jurisdiction of the Courts of Samoa.

4.14.4 The Promoter will donate a percentage of all profits generated from this Promotion to a charitable cause.

5. SMS OPT-IN

5.1 By voluntarily providing your mobile phone number and choosing to opt in, you expressly agree to receive marketing and promotional communications from AMTCircle via SMS. These messages may include, but are not limited to, updates regarding your account, exclusive offers, promotional campaigns, and other information relevant to AMTCircle products and services.

5.2 Your consent to receive SMS messages is entirely optional and is not a requirement for making a purchase or participating in any promotion. You may still engage with AMTCircle services without opting in to SMS communications.

5.3 The frequency of SMS messages may vary depending on promotional activity, seasonal campaigns, or your engagement with AMTCircle. Standard message and data rates may apply as determined by your mobile service provider. AMTCircle is not responsible for any charges incurred as a result of receiving SMS messages.

5.4 You may opt out of receiving SMS messages at any time. To unsubscribe, you may:

• Reply “STOP” to any SMS message received from AMTCircles;

• Click the unsubscribe link provided in the SMS (if applicable); or

• Contact AMTCircle directly using the contact details provided on our website.

5.5 For information regarding how your personal data is collected, stored, and used in connection with SMS communications, please refer to our Privacy Policy available on the AMTCircle website. AMTCircle is committed to protecting your privacy and handling your personal information in accordance with applicable data protection laws.

6. ACCEPTANCE OF TERMS

6.1 By placing an order with the Seller for the supply of Products and Services, or by accepting delivery of Products and Services supplied by AMTCircle, the Customer acknowledges and agrees to be bound by these Terms and Conditions.

7. LIMITATION OF LIABILITY

7.1 The Customer acknowledges that all Products are purchased based on their own skill and judgment. Any advice, recommendations, or assistance provided by the AMTCircle is offered in good faith and is believed to be accurate and appropriate.

7.2 AMTCircle shall not be held liable for any damage or defect resulting from improper care or failure to follow provided care instructions.

8. JURISDICTION

8.1 These Terms and Conditions shall be governed by the laws of Samoa. Both AMTCircle and the Customer irrevocably submit to the exclusive jurisdiction of the Courts of Samoa for any disputes arising in connection with these Terms and Conditions or the supply of Products.
